This guide is meant to be preceded by the Trademark Decision Tree guide, which is meant to help inform your choice to file a trademark. This guide consists of information documents necessary before filing, as well as an annotated preview copy of the USPTO trademark filing tool (2021). 

If you are undecided on whether to file a trademark, we recommend that you return to the first guide. If you feel that your trademark strategy is more complex than can be addressed by either guide, then we recommend that you seek counsel. 

How this guide is structured: 

This guide presents a preview copy of the USPTO trademark filing tool in greyscale. All our notes and annotations regarding highlights and important points are done in magenta.

Before filing, you will need: 

  • Business information about your company or yourself, including: office location, state of incorporation, and mailing address.
  • An image showing the product being used in commerce with the trademark visible, presented as a .jpg file. 
  • Knowledge of which class/classes you wish to file in. 
  • A written description of your product or service for each class you wish to file in.
  • A .jpg of your logo, if your trademark includes a design. 
  • A description of your logo, if your trademark includes a design. 
  • An email address that you will be regularly monitoring for USPTO communications
