NEW COLLECTIONS IN THE ARCHIVES: Judge Joyce Bihary Papers and Deborah A. DeMott Papers

The archives recently processed two small but informative collections from the National Bankruptcy Archives and the American Law Institute Archives. From the National Bankruptcy Archives, came the Judge Joyce Bihary Papers, and from the American Law Institute Archives, came the Deborah A. DeMott Papers.
Judge Joyce Bihary Papers
Joyce Bihary served for more than 25 years as a judge for the U.S. Bankruptcy Court in the Northern District of Georgia. On December 1, 2003 Judge Bihary was sworn in as Chief Judge of the same court, where she served until her retirement in May of 2012.
The Judge Joyce Bihary Papers include materials regarding debtor education, specifically the counseling program established in 1999 by the Coalition for Consumer Bankruptcy Debtor Education and the Georgia Consortium for Personal Financial Literacy. Additionally, due to her involvement in a 2009 bar discussion panel, the Papers include materials related to proposed "cramdown" legislation regarding giving bankruptcy judges the authority to modify mortgages on principal residences.

Deborah A. DeMott Papers
Professor Deborah A. DeMott was the sole Reporter for the Restatement Third of Agency. Professor DeMott received her J.D. from New York University in 1973 and joined the Duke Law faculty in 1975.
The Restatement Third of Agency project began in 1995 and lasted nearly a decade. As the sole Reporter, Professor DeMott noted the creation of durable powers of attorney, extending an agent’s authority to act on behalf of a principal, after the principal no longer has the capacity to act. This is one example of a development that ran counter to the Restatement Second of 1958. In addition, she discussed the importance of updating the Restatement Second of Agency, after nearly 40 years of ongoing legal development, changes in the business world, and society at large. In 2006, the American Law Institute published the Restatement (Third) of Agency.
The DeMott Papers include correspondence, notes, financial materials, printed materials, and multiple drafts of the Restatement (Third) of Agency.
