The ELP is published !!

During the fall semester, 21 members of the Environmental Law Project published a 42-page comment in the Federal Register, responding to an Advance Notice of Proposed Rulemaking from EPA on the issue of greenhouse gas emissions.

Because EPA's response to climate change has the potential to be the most important environmental regulation of the 21st Century, the ELP, under the guidance of Professor Cary Coglianese, weighed in on the flexibility of the current Clean Air Act (CAA) to respond to the sources of climate change.

After analyzing the legislation, the group determined that the current framework of the CAA would require residential and commercial buildings that operate on-site boilers and furnaces to obtain permits due to their emissions of greenhouse gases.  Due to the complexity of such a venture, the comment ultimately concluded that the CAA, by itself, was an ineffective framework for regulating greenhouse gases in all sectors and suggested several alternative frameworks focusing on non-industrial emissions and energy efficiency.

Participating members include Roland Backhaus, Linda Bartusiak, Elizabeth Corey, Seth Daniels, Alexander Dworkowitz, Zeynap Goral, Kwan Ting S. Ho, Christina Kaba, Kerri A. Kuhn, Jonathan Lane, Matthew Mcfeeley, Johnathan Peterson, Spencer Romney, Adam Schwartzbaum, Deena Shanker, Benjamin Simler, Eleni Skoufari, Brandon Tuck, Nathan Vogel, Ronald B. Wells and Gary Yen.
