Class Actions: Advancing Justice and Social Change
Thursday, October 27 at 6:30pm in G214
After the close of a rough Supreme Court term, attorneys are wondering about the continued effectiveness of class actions.  But over the years class actions have served as a powerful tools for social change, forcing to companies and government to change their policies and practices.  Class actions bring together those whose cases are individually week, but together can create a strong collective force for change.  Always remembering that class actions are a function of civil procedure, the impact of the Supreme Court's interpretation of Rule 23 in Dukes v. Wal-Mart remains an open question.  Come listen to some of the foremost experts on using class and collective legal actions for social change share about their recent cases, decision making processes for deciding to bring the action, and current challenges to using such cases for social change. Hosted by the National Lawyers' Guild Chapter, Civil Rights Law Project, and ACS.

A Discussion with Philadelphia District Attorney Seth Williams

Seth Williams, Philadelphia's first African American District Attorney, will be joining the Penn Law community to speak about the successes and challenges he has experienced thus far, his platform and how it differs from his predecessors, and what he ultimately hopes to accomplish during his tenure.  A West Philadelphia native, Seth graduated from the Georgetown Law Center, worked as an assistant district attorney, Inspector General of Philadelphia, and as counsel for Stradley, Ronon, Stevens & Young before being elected as Philadelphia's DA.  Sponsored by BLSA and co-sponsored by ACS.

The Diversity Committee of CSR presents Diversity on the Bench: Perspectives from Federal and State Judges.

This exciting program will feature: the Honorable Juan R. Sanchez of the Eastern District of Pennsylvania (L'81), the Honorable C. Darnell Jones of the Eastern District of Pennsylvania, the Honorable Dan Anders of the Philadelphia Court of Common Pleas, and the Honorable Judge Dawn Segal of the Municipal Court of the First Judicial District of Pennsylvania.  The program will include a discussion of the Judges' experiences prior to the bench and getting onto the bench. The program is a great opportunity to hear from exceptional judges and about their experiences on the bench.  The event is co-sponsored by ACS, BLSA, Lambda, LALSA, APALSA, SALSA, JLSA, PLWA, and Feminist Working Group.

Courting the Supremes!

Join the Penn Law American Constitution Society for a discussion on how the issue of same-sex marriage needs to be framed to persuade the Justices of the United States Supreme Court. Panelists will provide their insights to the cultural, legal theory, and practical arguments that will be most critical in presenting the issue within The Court. Is our society ready for same-sex marriage? Is it Constitutionally guaranteed? What are the most convincing arguments? Learn the answers to these questions, and have the opportunity to ask your own. The panel will be moderated by Professor Sophia Lee (Professor of Law, University of Pennsylvania Law School) and co-sponsored by Lambda Law.

The Constitution of 2020

Thursday, April 7th, 4:30-6:30, Great Hall (Reception to follow!)

The Constitution in 2020 project is the American Constitution Society's attempt to give progressive legal thinkers a platform to not only discuss consitutional theory but practical ways those theories can be implemented through either the judiciary or other branches of government. This panel discussion is centered around the question: Given the conservative leanings of the Supreme Court and the federal judiciary, what is the future for progressive constitutional scholarship and activism? The panelists are:

Kermit Roosevelt-Professor of Law at University of Pennsylvania Law School. Among Professor Roosevelt's many publications is his 2006 book The Myth of Judicial Activism which describes criteria for evaluating how activist the judiciary really is.

Sophia Lee-Assistant Professor of Law at University of Pennsylvania Law School. Professor Lee's scholarship has focused on administrative law and the role non-judicial actors play in shaping constitutional theory.

Jamal Greene-Associate Professor of Law at Columbia Law School. Professor Greene has written numerous articles and books on constitutional theory including biting critiques of originalism as a constitutional theory.

Alice Ristroph-Professor of Law at Seton Hall Law School. A scholar in the fields of both constitutional and criminal law, Professor Ristroph's current research focuses on efforts to use the law to reduce or regulate state violence.

"Who Owns the First Amendment?"

BURT NEUBORNE, Professor of Civil Liberties & founding Legal Director of the Brennan Center for Justice at NYU Law, will discuss an upcoming article that identifies the five players in any speech setting -- the speaker; the hearer; a conduit; the subject; and the regulator -- and asks how their interests interact and occasionally conflict.


This lecture was established in 2010 to honor the legacy of Professor Baker, one of the nation's premier scholars in First Amendment Law and mass media policy. For nearly three decades, he enriched the life of our Law School, winning awards for teaching as well as generating an impressive body of scholarship. ACS is proud to memorialize this inspiring individual with this annual event.

"Challenges Facing State Courts Today: Independence, Resources, and Advocacy"

Justice Brent Appel was appointed to the Supreme Court of Iowa in 2006. The court was embroiled in controversy when it unanimously voted to legalize gay marriage in 2009, and three of its members were ousted in the 2010 midterm elections. Justice Appel’s lecture will address a wide variety of contemporary challenges facing state courts. Students are encouraged to engage in a dialogue with His Honor about the issues raised by his remarks.

The Future of Globalism: A Discussion of Anti International Law Ballot Initiatives
with Professor Martha Davis, Northeastern University

Martha Davis, Professor at Northeastern University and expert on Human Rights Law, will speak on the constitutional questions that initiatives banning the consideration of international law or the mentioning of sharia law in state courts pose. She will present her recent ACS Issue Brief on the subject.

The Constitutionality of Healthcare with Professor Ruger
March 30 at noon, Room S-240 A

Professor Ted Ruger leads a discussion on the debate over the constitutionality of the new health care law. Recently a federal court in Florida struck down the new law, calling the law's individual health insurance mandate unconstitutional. This ruling makes two district court rulings upholding the law and two striking it down. This discussion will focus on the nuances of the debate's two sides, as well as the future of the new law.

ACS Writing Competition Reading Party

As you may know, this Friday February 18th is the deadline for the ACS National Writing Competition that the Penn chapter coordinates each year. After we collect all the submissions, we will need Penn ACS members to help us read and score the preliminary round of entries. We will narrow down the field and submit a maximum of seven final submissions to our panel of professors and federal judges who will ultimately decide on the winners.

We will celebrate our efforts with beverages and pizza!

Prison Privatization Debate  

With Professor Rudovsky and Professor Volokh of the Volokh Conspiracy!

ACS is excited to co-sponsor with NLG and the Prisoners' Education and Advocacy Project (PEAP) in hosting a debate between Professors Alexander "Sasha" Volokh and David Rudovsky on the topic of prison privatization. 

The event will be a one-on-one crossfire between two academic heavyweights.  Both professors are high-profile experts in prison privatization issues and the topic is one of emerging importance in economic policy and criminal justice.

How to Use Your Degree to Further Education Reform:  A Discussion with KIPP Co-Founder Mike Feinberg

Mike Feinberg is the co-founder of KIPP (Knowledge is Power Program), the largest charter school network in the country with 99 schools in over 20 states. Mr. Feinberg, a Teach for America alumnus, founded the KIPP program with the goal of preparing low-income students to graduate from college and pursue successful careers.

KIPP schools have been highly successful in reaching this goal. Mr. Feinberg will discuss how law and policy students can use their degrees to further the education reform movement and ensure that every child in our country has the opportunity to attain an excellent education.

In 1985, the U.S. Supreme Court issued a landmark opinion in Mitchell
v. Forsyth, rejecting the government’s position that high-level
executive officials are totally immune from lawsuits challenging the
government's national security actions.  Join Penn Law’s David
Rudovsky, who successfully argued Forsyth before the Supreme Court,
for a talk on the significance of this case and its continuing
relevance in post-9/11 litigation.

The Judicial Vacancy Emergency: Progressives & The Courts

Nan Aron, president of Alliance for Justice, a leading and influential nonprofit that has been fighting for access to justice and a fair and independent judiciary for over 30 years, comes to Penn Law to discuss the judicial vacancy emergency and what progressives are doing about it.

Judicial nominations have been fraught with dramatic and unprecedented delays, falling victim to a deliberate pattern of obstruction from Republicans in the United States Senate. ACS-FedSoc DEBATE: Affirmative Action in America Today

Come hear Linda Chavez and Wade Henderson debate the role of affirmative action in America today!
Ms. Chavez is a well-known television commentator who served in President Reagan’s cabinet and advised President George W. Bush on immigration. She is also the chairwoman and founder of the Center for Equal Opportunity, a conservative think tank devoted to issues of race and ethnicity.

Mr. Henderson is the president and CEO of the Leadership Conference on Civil Rights, a civil and human rights coalition that conducts legislative advocacy. He was formerly the Washington Bureau director of the NAACP and the associate director of the ACLU’s Washington office.

The debate will be moderated by Penn Political Science Professor Rogers Smith.
