Citation: How should society and the law respond when, for want of genetic ties, the father of a child seeks to relinquish his parental rights and responsibilities? How should policy makers, legislators and judges negotiate and reconcile the conflicting values and stakeholder interests which lie at the heart of such disputes? Despite the fact that this scenario is not uncommon, there is surprisingly little consistency in the law. Indeed, past cases reveal a confusing series of legislative and judicial choices which, when deployed, do not always yield ethically acceptable outcomes. Accordingly, this paper seeks to explore possibilities for an alternative values-driven model of paternity disestablishment which is comprehensive in scope and ethical in process and product.Toward that end, the authors begin by reviewing existing models by which society and the law recognize paternity in order to identify the chief social, familial and individual values grounding paternitys establishment. The purpose of this is to clarify those values which may be promoted or at stake in paternitys disestablishment so that if one is to be dishonored, it is done so only after sufficient deliberation.Second, the authors address two central criticisms leveled against existing paternity disestablishment laws; namely, that they are parent- or father-centered as opposed to child-centered and that they unjustifiably elevate genetic ties and, hence, genetic paternity, over and above other forms of and values attaching to paternity. In response, the authors identify the various stakeholders in paternity disestablishment actions and go on to explore their range of interests either in favor of or against the disestablishment of paternity. Third, the authors consider three value-based models which are potential frameworks for the analysis and resolution of paternity disestablishment contests. The authors seek to identify a model which both simplifies and unifies the adjudication of paternity claims while simultaneously being flexible enough to permit parents to rebut the policy's presumptions in exceptional circumstances.
