Billings Outlaws Likely to Prevail Over Orlando Outlaws
In perhaps the most closely-watched sports-related IP conflict of recent months, the owner of the Billings Outlaws, a professional indoor football team, is likely to prevail on his trademark claim against the rival "Orlando Outlaws." The Billings owner was thus entitled to a preliminary injunction.
The Billings Outlaw mark and related masked-cowboy designs, seen here, were heavily promoted and are strong when applied to the goods and services at issue. In addition, the two teams' marks and designs were overwhelmingly similar, the products, sales methods, and advertising methods were identical, and the Orlando Outlaws acted in bad faith when adopting the marks in question.
