EchoStar Enjoined and Liable for $74 Million
In a case involving digital video recorder (DVR) technology, the federal circuit affirmed a damages award of roughly $74 Million against Echostar. See TiVo, Inc. v. EchoStar Communications Corp., 2006-1574 (January 31, 2008).
In a suit for infringement TiVo contended that EchoStar’s 50X and Broadcom DVRs infringed U.S. Patent No. 6,233,389. The jury agreed with TiVo and awarded roughly $33 million in lost profit damages and roughly $41 million in reasonable royalties. In a 36 page opinion heavily devoted to claim construction the federal circuit reversed the judgment of infringement of some of the claims involved, but affirmed the judgment with respect to others. However, because the damages awards were not linked to specific claims, the court affirmed the damages awarded by the jury. A permanent injunction also appears to be part of the relief.
