Has Phillips Changed Anything? (Part 1)
In July 2005, the Federal Circuit issued an en banc decision in Phillips v. AHW, which addressed the methodological approach to claim construction. (One of us discussed this decision, and its implications here, and here.)
We now have empirical data allowing an analysis of the Federal Circuit's post-Phillips claim construction jurisprudence.
