Subject:           Draft for November 14-16, 2003 meeting

 

Enclosed is the draft of the Uniform Real Property Electronic Recordation Act for consideration at the November 14-16 meeting in Chicago.  Other materials for the meeting are also enclosed.

 

The November 14 meeting will begin at 9 am.  The November 15 and 16 meeting will begin at 8:30 am.

 

We will consider the section 5 issues (establishing standards for the electronic recording system) beginning on Saturday morning November 15.  As you know, section 5 may well be our most challenging matter.  Several Commissioners at the August annual meeting asked the committee to draft a provision that will assure interoperability of the various electronic recording systems throughout the state.  One of the alternatives for section 5 gives that result.  The other alternative strongly suggests that interoperability should be sought, but interoperability is not mandated.
