DRAFTING COMMITTEE ON MISUSE OF GENETIC INFORMATION IN EMPLOYMENT AND INSURANCE ACT

February 10-12, 2006 • Chicago

1.         Introduction of Committee Members, Reporter , ABA Representatives, Observers and Advisors and other NCCUSL members present.

2.         Discussion of additional stake holders to advise. Set times for lunch and adjournment. Dinner arrangements.

3.         Review of prior efforts of past Study Committees.

4.         Review of Committee Charge. Report from Study Committee to Scope and Program and Scope and Program’s Authorization.

5.         Overview of Reporter’s Work. Reprehensive sample approaches now in states by our Reporter, Ellen Deason.

6.         Discuss structure of possible Act. This should help us focus and get words to paper easier.

7.         Typical Structure:

Short Title. Start with Uniform Misuse of Genetic Information in Employment and Insurance Act

Scope of Act. Do we expressly set forth preempted area? Do we start by bringing in all use of Genetic Information in Employment and Insurance being controlled by the Act and then dealing with allowed uses, prohibited uses and regulation and enforcement or start up front with limiting our scope to only what we later determine is Misuse?

Definitions. The definition of Genetic Information will be most important

Substantive Provisions. Do we prohibit some or all use in certain circumstances? If so how much? Do we structurally set up the Act to prohibit some or all use unless permitted or vice versa? If not prohibited determine what use use will be regulated or conditioned. Regulation of testing and interpretation to foster competence. Work through the issues raised in Study Committee Final Report to Scope and Program.

Enforcement. Agency, Civil, Criminal.

Effective Date.

8.         Direction to Reporter for specific drafting.

9.         Set next meeting if possible.

10.       Adjourn. Not later that noon Sunday for those making flight arrangements.
