From:   Harry Haynsworth

Memorandum

            With this memorandum are the following documents:

1)         a memo from Bill Clark, George Coleman and Jon Hirschoff setting out the main issues we are going to discuss on November 9th;

2)         a redlined copy of the UEnTA Annual Meeting Draft, which incorporates most of the changes recommended by the NCCUSL Style Committee; and

3)         a copy of Real Property, Probate and Trust Journal article on MITA by Bob Keatinge and Tom Geu, which contains a draft of MITA as an Appendix.

            This planning session on November 9th will not be an official meeting of the Drafting Committee and no final decisions will be made at this meeting.  The purpose is to determine whether there is a consensus on how the various merger issues should be resolved, and where there are differences of opinion, to suggest how these differences can be best presented for resolution at the next Drafting Committee meetings, which are now scheduled for February 13-15, 2004 and March 12-14, 2004.

            The planning session will begin at 8:30 a.m. on Sunday in the same room as the ULLCA meeting and is scheduled to last until around 4:00 p.m. Sunday afternoon.  If you are unable to stay the entire meeting, please come for as long as you are able.
