RE:        MATERIALS FOR CHICAGO DRAFTING COMMITTEE MEETING

LADIES AND GENTLEMEN:

Attached are the following materials for consideration at our meeting next week:

1.         The current draft of the Uniform Common Ownership Interest Act. This is the same draft as the draft that was considered on the floor of the 2006 Annual Meeting; the sole additions are comments from commissioners that I have inserted at the appropriate places. They are entitled “2006 Annual Meeting Comments.”

2.         The most recent AARP report and recommendations concerning a Bill of Rights. This document includes proposed model text for each of the recommended sections.

3.         A recent decision from the Connecticut Supreme Court entitled Weldy v. Northbrook Condominium Association, which interprets the uniform act as adopted in Connecticut. The case considers the extent to which an association board may adopt regulations interpreting provisions in the declaration.

4.         Finally, a recent article from the New York Times entitled “Appeals Court Limits Co-op Boards’ Powers.”
