MEMORANDUM

 

TO:                  UCIOA DRAFTING COMMITTEE

RE:                  Materials for Phoenix Meeting

 

In anticipation of our approaching meeting, I enclose the following:

 

1.                   The draft of the Act as it was presented to the Floor of the Conference.  This draft was prepared after our last meeting in Chicago and includes a number of questions to which Carl and I felt we would like reaction from the full commissioners.

 

2.                   Interspersed in the Act as drafted are various written comments received from various commissioners during or after our floor discussion.  The text of the comments has not been edited; Carl and I have not discussed those comments at all and they emphatically do not represent views on which we were consulted.  Nevertheless, they may or may not be useful to the drafting committee and advisors.

 

3.                   The full transcript of the floor discussion, edited only to exclude totally irrelevant remarks and to include signals as to where the discussion moves from topic to topic.

 

4.         A copy of the Uniform Non-Judicial Foreclosure Act – without comments - since that Act has been suggested as a road map of procedural safeguards for foreclosure of association liens.

 

Other Materials –

 

1.         I have been given a copy of recent Colorado legislation in the field and will shortly prepare a summary of it for our discussion in Phoenix.  If any of you feel there is other recent legislation that we should consider, please let me know.

 

2.         We are trying very hard to have representatives of the Insurance industry present to discuss Section 3-113 [insurance] with us.  Please be especially prepared to discuss that topic in detail.

 

3.         At this date, we do not have further information from the AARP or other relevant bodies concerning any positions they might hold.  You may, however, wish to bring with you the materials we distributed before the March meeting.
