STATEMENT ON UNIFORM COMMERCIAL CODE

ARTICLE 2B - LICENSES



NATIONAL CONFERENCE OF COMMISSIONERS

ON UNIFORM STATE LAWS

JUNE 16, 1998



On May 6, 1998, the President of the National Conference of Commissioners on Uniform State Laws (NCCUSL), Gene N. Lebrun, announced that Uniform Commercial Code Article 2B - Licenses, would not be sent to a final vote by the NCCUSL at its 1998 Annual Meeting in Cleveland, Ohio, and that a final uniform act would be promulgated no earlier than the NCCUSL Annual Meeting in July, 1999. In addition, he announced that meetings of the Drafting Committee are already projected for November, 1998, and asked interested parties to submit proposed amendments to the NCCUSL national office in Chicago by October 10, 1998, so that they can be considered at the November meeting. When the exact time and place for the November meeting is established, it will be posted at http://www.nccusl.org.



The Uniform Commercial Code is a joint project of the NCCUSL and the American Law Institute. The American Law Institute (ALI) will consider the draft of Article 2B in its proceedings in 1998 and 1999. Final approval by the ALI can occur no earlier than its May, 1999 Annual Meeting. Any addition to or revision of the Uniform Commercial Code requires the approval of both the NCCUSL and the ALI.



There is much speculation on the Internet and within the press and media about the impact of this process. The NCCUSL emphasizes that its drafting committees operate as open public forums that solicit and encourage input from any and all sources. That is the tradition and fundamental policy of the NCCUSL as a state governmental association. The Drafting Committee on Uniform Commercial Code, Article 2B continues in that tradition. Every interested party continues to have the opportunity to participate in the continuing effort to draft this important piece of legislation.



Further, the NCCUSL does not propose unfinished uniform acts to the state legislatures for adoption, and will actively discourage anybody else from proposing any uncompleted uniform act for introduction in any state legislature. This is also consistent with the practices and tradition of the NCCUSL.
