Memo to:  RUAGA Drafting Committee and Observers

From:  Carlyle C. Ring Jr., Chair

Date:  March 5, 2006

Re:  Meeting of April 21-23 in Detroit

You should have received from the Chicago Office information on the meeting as follows:

Friday morning until Sunday Noon, April 21 - 23

Courtyard Marriott

333 East Jefferson Ave.

Detroit, MI 48226

313-222-7700

This is our last scheduled Drafting Committee meeting.  It is anticipated that the RUAGA final reading will occur at the Annual Meeting of NCCUSL during the week of July 7-14, 2006.

Under separate cover, Observers will receive a Questionnaire which we would very much appreciate the Observers completing and returning before the April meeting.

Enclosed is the revised draft of RUAGA which we will discuss at the April meeting.  The Reporter has revised this draft to reflect the directions given by the Drafting Committee at the November meeting and suggestions forwarded by many of you since November.

At the April meeting in Detroit, we will discuss each Section in order. I strongly urge, if you have concerns, to draft revised proposed language and give it to the Reporter in advance of the meeting or bring rewording suggestions to the meeting

The Comments are provided for your information only. Comments are not finalized until the Act is promulgated.  The Reporter and I welcome your suggestions for the comments by email but the comments will not be discussed at the April meeting.

The UNOS website, http://www.unos.org/Resources/factsheets.asp?fs=6, contains a table on First Person Consent (FPC) and Registries. As I interpret that information, there are 7 states without FPC; 7 states where the family can override the Donor’s gift; 15 states without any current operational registry; and 23 states without some kind of access to DMV records. The table may provide some food for thought and topics for consideration in reviewing the revised draft.

Also enclosed is a Position Paper received from NAME.
