The inner workings of a judge’s brain are usually as
closed as his chambers. But at this spring’s Institute for Law
and Economics Distinguished Jurist Lecture, Chief
Judge Vaughn R. Walker of the U.S. District Court for California’s
Northern District offered a rare glimpse into the rationale
for his ruling in the Oracle antitrust case, a decision
that permitted the software company’s hostile acquisition of
PeopleSoft in early 2005.
One of Walker’s chief criticisms of the government’s case
against Oracle was its heavy reliance on the testimony of handpicked
tech industry customers.
